Sjøbris Adventure AS, Gate 6 79, 6700 Måløy, org.no. 923 225 323, sells and rents out products and services.

1. General

These terms apply to the rental and sale of goods and services from www.sjobrisadventure.no and www.booking.sjobrisadventure.no to businesses and consumers. By placing an order, you agree to purchase or rent the selected products or services in accordance with these terms.

2. Definition of Parties

The Lessor or Seller is Sjøbris Adventure AS and is hereinafter referred to as we, us, lessor, seller, or Sjøbris Adventure.

The Lessee and Customer is the person specified as the lessee or buyer in the order and is hereinafter referred to as lessee, customer, you, your, or yours.

The term "rental objects" and "products" refer to equipment and anything else leased and purchased on www.sjobrisadventure.no and www.booking.sjobrisadventure.no.

3. Payment and Prices

Payment is made via Vipps, Visa or Mastercard online through our payment intermediary Nets, which meets the strictest security requirements. The customer pays upon ordering, and the rental agreement is considered entered into.

All prices include value-added tax unless otherwise specified. The total cost of the purchase will be displayed before ordering and includes all expenses associated with the rental or purchase. If there have been significant pricing errors on the website from Sjøbris Adventure, Sjøbris Adventure may unilaterally change, delete, or reject orders even after the customer has received order confirmation or similar. However, such errors must be corrected, and the customer must be informed within a reasonable time after the error is discovered.

4. Condition of Rental Object

Sjøbris Adventure undertakes to deliver rental objects of high quality in operational condition. Sjøbris Adventure has its own procedures that check and maintain rental objects before and after rental.

The lessee is obligated to check the rental object before use and contact Sjøbris Adventure if the rental object is not in the expected condition.

5. Use of Rental Object

The use of rental objects is at your own risk. The person using the equipment must be over 18 years old. Individuals under 18 years old must be accompanied by an adult.

Correct and safe use of the equipment is the responsibility of the lessee. The lessor facilitates the proper use of the equipment by providing user manuals, instructions, and safety procedures.

6. Damages

All damages, technical malfunctions, or accidents that may occur during the rental period must be reported to Sjøbris Adventure immediately. We will do our best to assist the lessee. Damages are reported by phone at +47 952 44 993 immediately.

The lessee agrees to reimburse the lessor for all costs and expenses related to the repair or replacement of damaged property if the damages occur due to incorrect use, intent, or negligence. This also applies if the equipment is returned in a neglected state or is returned dirtier than normal.

8. Rights and Obligations

The lessee must be at least 18 years old and is obligated to provide correct customer details when creating a user account to place orders and rentals on www.booking.sjobrisadventure.no. Sjøbris Adventure sends messages to the specified email, address, or phone, and such messages are considered received and valid upon dispatch from us.

Sjøbris Adventure has the right to freely reject, terminate, or suspend a user account without notice or liability, including if the terms are deemed breached.

9. Cancellation and Amendment of Order

To cancel or amend an order, Sjøbris Adventure must be contacted. Cancellation or changes will not be valid until confirmed in writing by us.

Cancellations or changes more than 24 hours before the appointment provide a full refund. Cancellation less than 24 hours before the appointment provides no refund.

If Sjøbris Adventure, for any reason, cannot fulfill the reservation due to technical problems or other external reasons, the reservation will be canceled, and the customer will be refunded the amount for the reservation.

Sjøbris Adventure cannot guarantee the weather or the view. In extreme weather and other force majeure situations such as a pandemic, war, riots, blockade, natural disasters, strikes and lockouts, import restrictions, hyperinflation, robbery, burglary, alien invasion, and monkeypox, the customer will not be refunded payment for the service that cannot be carried out.

10. Right of Withdrawal on Purchase

The right of withdrawal law gives you the right to withdraw your purchases. The right of withdrawal applies to products purchased and not for rental objects. The right of withdrawal requires that you notify us no later than 14 days after receiving the delivery.

To exercise the right of withdrawal, the product must be returned to us in approximately the same quantity and condition as you received it.

The product is returned to us in its original packaging and in a reasonable time, along with the withdrawal form. If you choose to return it by mail or other methods, it is your responsibility until the item reaches us. You must provide your own suitable packaging and contact us before shipping.

11. Privacy

Sjøbris Adventure processes your personal information in a secure data register to fulfill its obligations and protect its rights under the rental agreement. The processed personal information includes name, address, telephone number, email address, and order history. This history will remain stored for accounting and other obligations. All stored information is available on "My Account." The lessee has the right to have their personal information removed from the lessor's systems, which can be done by contacting Sjøbris Adventure personally.

Your payment card will be stored as long as you have an active order. The storage of the payment card occurs with our payment intermediary Nets. They store the information securely and responsibly. Storing the payment card makes it even easier when you shop. You can delete payment cards on your page. Sjøbris Adventure does not store credit card details itself.

Sjøbris Adventure uses cookies, like most other online stores. Cookies store data in your browser so that the website can recognize you from page to page and visit to visit. We can then recognize who you are so that you can get correct prices and easier login. We also collect usage information to improve service quality.

12. Changes

Sjøbris Adventure reserves the right to change or replace these terms at any time. The applicable terms are always available at www.sjobrisadventure.mysharefox.com. If Sjøbris Adventure considers the changes in the terms to be significant in relation to the lessee's rights or obligations, the changes will be made available on www.sjobrisadventure.no and www.sjobrisadventure.mysharefox.com 30 days before they take effect.
